DUTY OF CARE:
The Representative shall
- Make a diligent and business like effort to learn the information about the client that is pertinent to his or her needs.
- Put the interest of a client ahead of the Representative’s own direct or indirect interests.
- Provide a quality of service which is generally expected of a competent professional in a similar situation.
- Keep proper documentation on a client’s needs analysis
CONFIDENTIALITY:
The Representative shall
- Advise a client as to the purposes for which personal information is being or was collected and any changes of such personal information.
- Protect personal information with security safeguards appropriate to the sensitivity of the information.
- Comply with all legislation relating to communication with clients or perspective clients for the sale of both insured and uninsured products and services. Including, but not limited to anti-spam and National Do Not Call List (DNCL) regulations
- Comply with applicable federal and provincial privacy legislation.
DISCLOSURE:
The Representative shall
- Comply with the duties and obligations in respect of ADVISOR DISCLOSURE, as required by provincial licensing bodies (or regulatory authorities) including providing a written ‘Advisor Disclosure Statement” to the client or applicant (if required by such authorities).
- Provide to an individual, before giving advice on a product or services, information about the Representative’s affiliations and qualifications.
- Present accurately, honestly, completely and in plain language all facts reasonably available to the Representative necessary to enable a client to make an informed decision about a Blendable product or service.
- Report to Blendable any client complaints, regulatory inquiries or investigations within (1) business day of the Representative’s knowledge or notice of such.
CONFLICT OF INTEREST:
The Representative shall
- Disclose to a prospective buyer of any conflicts of interest or potential conflicts of interest associated with the proposed transaction or recommendation.
The Representative shall not engage in the following activities:
- Holding out, directly or indirectly, by representation or omission, in a way that is misleading about the products and services that the Representative can provide.
- Misrepresenting his or her training qualifications or skills.
- Making any false or misleading statement or representation in the course of selling.
- Using methods of soliciting or advertising that are misleading as to the terms, benefits or risks.
- Using coercion or undue influence in order to control, direct or secure business.
- Taking advantage of a client if the Representative knows or ought to know that the client is unable to understand the character, nature, language or effect of the transaction or proposed transaction.
